1. Purpose of the document

These Terms of Use (hereinafter: Terms) govern the use of the COMIND knowledge-based intelligent digital assistant demo (hereinafter: Digital Assistant) by natural persons (hereinafter: the User), developed and operated by Telekom Rendszerintegráció Zrt. (registered office: 1097 Budapest, Könyves Kálmán körút 36.; company registration number: 01-10-044852; hereinafter: Service Provider)

2. About the Digital Assistant and how it works

Telekom's Digital Assistant solution is recommended for large enterprises and SMEs, and its basic functions can be explored in the online demo made available by the Service Provider. 

The Digital Assistant is based on artificial intelligence (AI) technology, which uses algorithms, integrated large language models (LLM) and pre-provided information, data, documents and data sets (hereinafter: Knowledge Base) to automatically analyse user information, questions and instructions (hereinafter referred to as Input) and relevant information, answers and references (hereinafter referred to as Output) are generated for the purpose of familiarising users with the basic functions of the Digital Assistant and marketing the Digital Assistant. 

The Digital Assistant has a limited knowledge base regarding its own business opportunities, advantages and capabilities, but it is intended for demo purposes only and does not contain all the elements of the full version with functionality to be sold to customers.

The LLM component of the Digital Assistant is provided by Microsoft as part of the Azure OpenAI Service.

3. Nature of Outputs

The User acknowledges and agrees that 

  1. there is no human intervention in the generation of the Outputs, and therefore the Outputs are for informational purposes only;

  2. the Outputs do not constitute official legal, financial, health or other professional advice/opinion;

  3. the Outputs do not create a contract or constitute an offer or acceptance, nor do they create a customer relationship;

  4. LLM technology has limited understanding of linguistic context, which may result in inaccurate, ambiguous, unpredictable or misleading Outputs;

  5. the general truthfulness, factuality, usefulness, completeness or commercial usability of the Outputs is not guaranteed when using the Digital Assistant;

  6. LLM technology is not capable of fully taking into account unique situations, so the Outputs cannot be considered personalised expert advice or solutions;

  7. The Outputs are based on the available Knowledge Base, the elements of which may become obsolete or change over time; the Service Provider updates the Knowledge Base at specified intervals.

  8. Before using or sharing the Outputs, it is recommended to conduct a critical review, taking into account all the circumstances of the specific use case.

  9. The Outputs may refer to third-party products or services, which does not imply that the Service Provider has any contractual or other relationship with such third parties.

4. Prohibited Use

The User may use the Digital Assistant for its intended purpose, in accordance with applicable laws and ethical guidelines, and warrants that they will not use the Digital Assistant for any illegal, harmful or abusive activities, in particular the following are prohibited:

  1. using the Digital Assistant in a manner that results in a violation of the law, constitutes a prohibited AI practice under the EU Regulation on Artificial Intelligence (2024/1689), or infringes the rights of other third parties;

  2. modifying or reworking the Digital Assistant, discovering or reverse engineering its source code or underlying components (including our models, algorithms or systems), or exploring its databases, operating principles, basic ideas or algorithms that are not apparent from its intended use;

  3. selling or distributing the Digital Assistant;

  4. automatically or programmatically extracting data or Output from the Digital Assistant;

  5. stating that the Output was produced by a human being, if this is not true;

  6. using the Digital Assistant in or in connection with any high-risk activity that could cause environmental damage, health damage, physical injury or death;

  7. interfering with the Digital Assistant, including circumventing any restrictions or defeating any security measures or safety risk mitigation measures associated with the Digital Assistant.

5. Responsibility for the use of the Digital Assistant

The Service Provider shall not be liable for any direct or indirect damages resulting from the use of the Digital Assistant, the Inputs, the Outputs or their incorrect interpretation, including in particular (i) financial, business or personal losses, (ii) the consequences of incorrect decisions, conclusions or predictions, (iii) loss of data or information or security incidents, (iv) damages resulting from reserved and delayed services, events or programmes, (v) damage to reputation. If the Outputs refer to external sources (e.g. government agencies, other service providers' websites), the Service Provider is not responsible for their content.  

The use of the Digital Assistant is solely at the User's own risk. The User is responsible for (i) the content and legality of the Inputs, (ii) not sharing personal or other data subject to usage restrictions when using the Service, and if the provision of such data is unavoidable or is nevertheless shared, to ensure compliance with the legal requirements for data transfer, as well as (iii) for decisions made based on the Outputs, and for actions taken or omitted.

A személyes adatok nem kerülnek harmadik országba (azaz az Európai Unión kívülre), illetve nemzetközi szervezet részére továbbításra.

6. Data protection

It is the user's responsibility not to share personal or other sensitive or restricted data on the Digital Assistant interface, during interactions initiated with the Digital Assistant, or when formulating Inputs. With regard to data processing related to the Digital Assistant, is considered the data controller ; detailed information on data processing is available here:

6. Right to change

The Service Provider does not guarantee the continuous availability or error-free operation of the Digital Assistant and is entitled to modify, temporarily suspend or terminate the functions of the Digital Assistant without prior notice to Users.

The Service Provider also reserves the right to modify the content of these Terms and Conditions without prior notice to Users.
